1. Terms and Conditions

Christy Organics is an Australian entity and subject only to Australian laws and jurisdiction, so these Terms & Conditions (and any other terms, conditions, policies or procedures/guidelines that we provide) are only available in English.

Accepting the Terms & Conditions and Policies

By clicking PLACE ORDER, you confirm that you have read, understood and accept our Terms and Conditions, Shipping and Delivery Policy, Returns and Refunds Policy/Procedures and Security and Privacy Policy.

Eligibility

To be eligible to purchase goods on this Site and to lawfully enter into and form contracts on this Site under the law you must: (a) be aged 18 or older; (b) submit the required details on the Site; and (c) be the holder of a valid Paypal account or debit/credit card.

Prices and Payment

All prices on the website are in Australian dollars and are inclusive of GST (where applicable) and are exclusive of delivery charges. Prices are subject to change without notice.

The total cost of your order is the price of the products ordered and delivery charges as set out in the Shipping and Delivery of the Site.

All orders must be fully paid for prior to shipping.

The payment options we accept are:

–      Paypal and

–      Direct Deposits to our designated bank account. Please contact us if you choose to pay via Direct Deposit.  We will advise you the details of our bank account and you will be required to email your official Direct Deposit receipt to us so that your order can be dispatched promptly.

Orders can be delayed if payment confirmation is not presented, as we will have to wait for funds to be cleared.

2. Returns and Refunds Policy and Procedures

Rule 1

You may return any product (except free sample and sale/discounted items) in its original condition purchased on the Christy Organics website to www.christyorganics.com for refund or exchange within 14 business days from delivery. All orders must be checked upon receipt and any claims, errors, or discrepancies must be reported immediately.

The returned product or item must be unopened, unused and in its original saleable condition. In compliant with the Health and Safety regulations, we cannot accept returned products or items that we reasonably believe have been used or opened.  You are responsible for the shipping, additional postage/delivery and handling charges.

Products purchased from reseller, in a department store, specialty retailer or elsewhere must be returned to their original point of purchase.

Please ensure you obtain a Proof of Postage when you return the products to us. You should retain your Proof of Postage in order to provide proof to us that you have returned the products, in the unlikely event that we do not receive the returned parcel.

If you are eligible for a refund, we will refund the price paid by you for the products (exclusive of the initial shipping/delivery and handling charges) within thirty (30) days of receiving your returned products, provided that you have returned the products to us in their original condition at our designated address within 14 working days of delivery. You will receive email notification of your refund from our Customer Service Team.

 

Rule 2

Refunds will only be made against the original Paypal account or credit/debit card used.

If you cancel your order but do not return such products to us within 14 business days, we will not be able to process the refund to you and shall be entitled to collect such products from you and to charge you for the direct costs of collecting the products. You should note these charges (which may be deducted from a refund) are likely to exceed the costs of you returning the products. Until such products are returned to us, you are obliged to exercise all reasonable care to store the cancelled products safely and in appropriate conditions (according to the storage information specified on the product leaflet).

 

Rule 3

We cannot accept returned products or items that we reasonably believe have been used or opened. In such circumstances, we will notify you that no refund will be available and you will be responsible for arranging for such goods to be returned to you (if you wish) within 28 days of our notification.

 

Incorrect Product or Item

Should you make an error when ordering online, Christy Organics will gladly exchange your item for the item you intended to purchase.  In this scenario, free shipping (if offered on the website) is not applicable to the exchange transaction.

The returned item must be unopened, unused and in its original saleable condition. You are responsible for the shipping, additional postage/delivery and handling charges.

 

Damaged or Faulty Product/Item

If the items you receive are damaged or faulty in any way, we will be happy to exchange the items or offer you a refund.

Please notify us immediately by calling our Customer Service Team on +61450 225 606 (Monday to Friday 9am - 5pm AEST).

To assure prompt resolution, please provide the order number and keep the box, packing materials and the damaged items for inspection by the carrier.  You may be required to provide evidence of the damaged item(s) before your replacement or refund could be processed. 

If you have requested an exchange or replacement, your request will be processed within 7 business days of receiving your returned goods in a satisfactory condition.  The replacement/exchange item(s) will be delivered via standard delivery.

3. Shipping and Delivery

We will deliver the goods in accordance with the delivery option selected by you on your order.

Orders are processed for delivery on business days only (Monday through Friday, excluding public holidays).

We will take all reasonable care to ship your order to the delivery address given by you. However we will not be liable for non-delivery or mis-delivery as a result of incorrect data entry.

The carrier’s details and shipment tracking number if available will be given on your shipping confirmation email.  Please go to the carrier’s website to track your parcel.

Any delivery timescales quoted to you are indicative only. Orders may be delivered in one or more parts. We do not accept any liability whatsoever for delayed delivery caused by any third party carrier or Australia Post.

Australian Deliveries

Where the order is to be delivered to an Australian address, we will:

–      Use reasonable efforts to process the order within five business days (Monday – Friday, excluding official public holidays) from the date the order was submitted by you; and

–      Process your order within one business day for express delivery option (where applicable).

Christy Organics takes no responsibility for any items lost or damaged or any delay that occurs during shipping by the carrier or Australia Post using the standard delivery method. Items shipped with Australia post by the standard (Without tracking) delivery method cannot be tracked after dispatch. The customer will therefore assume all risks in situations such as these.

 

International Deliveries

Where the order is to be delivered to an International address, we will:

Use reasonable efforts to process the order within seven working days (Monday – Friday, excluding official public holidays) from the date the order was submitted by you.

International shipping may require legal documents for import purposes. Please check with your local shipping agent or Customs Authority. You are responsible for any import taxes/custom duties/penalties/levies/brokerage fee for the shipment

 

Christy Organics will not be liable for packages refused or held by customs for delivery.

We request that you contact your country’s Customs Authority and ask about import regulations and restrictions before placing your order. It is important for you to become familiar with Customs policies for your specific country before ordering. Customs regulations differ by country and not knowing their regulations can result in your order incurring high import duties, the delivery being delayed or even returned. Please check with your Customs Authority/Office to see if your country permits the shipment of the products you are planning to order from us and if any additional licenses or permits are needed.

Please Note: If your order is returned to us due to a banned/restricted products policy, a wrong address, refusal to pay customs fees, refusal to accept the order or because no one was there to accept delivery of your order, we will refund your Paypal or debit/credit card as follows: You will be refunded the total amount of the order, minus the shipping & handling charges (Expenditure of Christy Organics), and 20% of the value of the order, (as a re-stocking fee). We will also subtract any other outside charges ChristyOrganics.com has incurred during shipping, such as warehousing fees, return postage fees, etc.

If the cost to return the product to us is larger than the cost of the refund due, we will instruct the carrier to abandon the order and there will be no credit for the order. If the product(s) is seized by customs, there will be no credit processed for the product(s).

Refunds are not available if you choose International Airmail as a shipping method and your order is lost. Also, refunds will not be issued until we physically receive the returned packages.

Title to Goods and Risk of Loss

We will retain the legal ownership of the goods until you have made full payment and such payment has been received by us. Legal ownership of the goods will immediately revert to us if we refund any such payment to you.

Risk of loss of the goods will pass to you upon delivery to you.

 

Acceptance of Goods

Upon receipt, you must inspect the goods. You will be deemed to have accepted the goods unless you notify us that you have cancelled the order and/or you return the goods in accordance with the Returns and Refunds policy and procedures. If no such action is taken, we shall not be obliged to accept any rejection of the products or goods at a later date.

Using Paypal

We are a registered PayPal merchant.  We do NOT store your financial/bank account or credit card details.

We use industry standard security measures to safeguard and protect your information. This includes taking reasonable steps to ensure your personal information is protected from misuse, loss, unauthorised access, modification or disclosure.

5. Privacy Policy

Christy Organics recognizes the importance of protecting the privacy of our customers and other third parties who provide their personal information to us.
  Our policy for dealing with your personal information is explained below (Privacy Policy).

Our Privacy Policy was last updated on 8 July 2014 and includes disclosure of the matters set out in the Australian Privacy Principles.

Personal information we collect

When used in this policy, “personal information” has the meaning given to that term in the Privacy Act 1988 (Cth). Personal information generally includes any information that can be used to personally identify you.

If you provide information to us in hard copy (paper) this information is normally retained in our files and a copy is made to our electronic files. 

If we are unable to collect your personal information

If we are unable to collect your personal information, some or all of the following may occur:

  • we may be unable to provide products or services to you, to the requested standard or at all;
  • we may be unable to communicate with you to provide information about products and services that you have purchased from us, or may intend to purchase in the future;

Your personal information will not be shared, sold, rented or disclosed other than as described in this Privacy Policy.

 

Direct Marketing

We may send you direct marketing communications and information about products and services offered by us, affiliates, partners or suppliers via email, SMS, or regular mail.

If you have indicated a preference for a method of communication, we will endeavour to use that method wherever practical to do so.

Normally we will provide a record of your personal information to you via your preferred contact method (phone, email or mail), and we will not charge a fee.

If your request is unlawful or may interfere with the privacy of others we may reasonably refuse to provide access to your personal information.

 

Correction of your personal information

You have a right to modify and delete all the personal information which we hold concerning yourself in the “My Account” on our website.

If you would like us to update or amend your personal information, please contact us and we will make the requested amendments.

We may ask you to verify your identity to ensure that personal information we hold is not improperly accessed.

Complaints

If you feel your privacy has been breached, please contact us using the contact information above setting out the circumstances and reasons for your complaint. 

Our team members will acknowledge receipt of your complaint within 24 hours, and will normally respond to your request within 10 business days.

If your complaint is complicated or requires further investigation our response may take additional time to finalise.

We will respond to you by your preferred contact method if you have indicated one.

 

Overseas disclosure of personal information 

We may disclose your personal information to third parties and service providers located overseas in connection with a Purpose.

We take reasonable steps to ensure that the overseas recipients of your personal information do not breach the privacy obligations relating to your personal information.
